Welcome to Docmint (available at https://docmint.app/). Before using our platform, please read these Terms of Use and General Terms of Service ("Terms") carefully. They regulate the legal relationship between DOCMINT ("Platform", "we", or "our") and the individual or legal entity that accesses or uses our services ("User", "Client", or "you").
1. definitions
For the purposes of these Terms, the following definitions apply:
Docmint: Web3 technological platform accessible via web browser, responsible for intermediating the generation of timestamps and anchoring of metadata on blockchain networks.
Blockchain: Distributed, immutable, decentralized, and public ledger (global decentralized network) in which cryptographic transactions are recorded.
Cryptographic Hash: Unidirectional mathematical identifier generated algorithmically from the exact content of a digital file. Any change in a single character or byte of the file generates a completely different hash.
Anchoring / Tokenization / Minting: Technical process of recording the cryptographic hash and the document's timestamp in a smart contract or NFT on the blockchain network.
Timestamp: Temporal record certifying that certain information (in this case, the hash) existed on a specific date and time.
Local Processing (Client-Side): Security mechanism by which the algorithmic calculation of the hash is performed directly in the User's browser and device, without the file's content being transmitted to Docmint's servers.
Certificate / Registration Receipt: Metadata or interface provided by the Platform to demonstrate the blockchain transaction corresponding to that registration.
2. object and nature of services
2.1. What Docmint is:
Docmint is a technological service provider that acts as an intermediary interface (technological bridge) between the User and a public blockchain network. The service consists of:
- Allowing the local generation of the mathematical signature (hash) of the file inserted in the interface by the User;
- Transmitting this mathematical hash for inclusion in a blockchain transaction after payment confirmation;
- Providing a public and decentralized validation interface for future verification of the file's existence and integrity.
2.2. What Docmint is NOT (Distinction from Notaries and Notarial Services):
Docmint IS NOT A PUBLIC REGISTRY NOTARY, nor does it exercise any notarial or registry activity delegated by the Public Power along the lines of Federal Law No. 8.935/1994.
The service does not grant original state public faith to documents and does not replace mandatory constitutive public records required by law (for example: real estate registry of buying and selling properties, public mercantile registry before Boards of Trade for opening companies, patent registration at INPI, or settlement of titles and documents for erga omnes effectiveness against good faith third parties when the law requires specific public solemnity).
Registration on Docmint consists of a documentary technical proof tool of priority and cryptographic integrity, fully admitted by Brazilian civil procedural law as lawful atypical proof (art. 369 of the Code of Civil Procedure) and electronic document of free probative appreciation (arts. 411, II and 422 of the CPC).
3. technical architecture and absolute privacy (privacy by design)
3.1. No File Transmission to Servers:
The User declares awareness that Docmint operates under the Absolute Privacy model:
- The original file (text, image, audio, architectural project, video, source code, contract, or any other format) IS NEVER sent, transmitted, or stored on Docmint's servers or databases.
- The entire hash calculation process is strictly executed in the User's own browser and device (client-side).
- Only the alphanumeric string representing the Cryptographic Hash travels the network to be inserted into the blockchain.
3.2. Indispensable Duty to Keep the Original File by the User:
As Docmint does not keep a copy of files, it is the User's sole, personal, and non-transferable responsibility to keep the original file safely stored and untouched.
For a future validation to be successful, the file submitted on the validation page (/verify) must be strictly bit-by-bit identical to the file used at the time of registration. Any alteration (even opening and resaving in some software, format conversion, or image compression) will alter the hash, making technical correspondence with the blockchain record impossible.
Docmint has no technical, operational, or legal capacity to restore or recover files lost, corrupted, or deleted by the User.
4. independence and perpetuity of the blockchain
4.1. Survival of the Record:
Once the hash is anchored and mined/validated in the blockchain block, the record becomes eternal, perennial, immutable, and decentralized.
4.2. Docmint's Independence:
The recorded proof does not depend on the survival of Docmint, its servers, or its commercial activity. Anyone, at any time, with the original file in hand, can verify the hash directly in public block explorers of the respective network or through independent smart contracts, even if Docmint ceases its activities.
5. registration, eligibility, and use of the platform
5.1. Civil Capacity:
The Platform is intended for fully capable individuals (over 18 years old or emancipated under Brazilian law) or legal entities duly constituted and represented by those holding legal powers to do so.
5.2. Ethical and Legal Use:
The User undertakes not to use the Platform to:
- Practice fraud, scams, or embezzlement;
- Attempt to register malicious code, viruses, ransomware, or files intended for device invasion;
- Commit acts that constitute a deliberate violation of third-party intellectual property;
- Perform denial of service (DoS/DDoS) attacks against Docmint's infrastructure or interconnected blockchain nodes.
6. responsibility for content and copyright
6.1. Declaration of Ownership:
By registering a document's hash on the Platform, the User declares and guarantees under penalty of law that:
- They are the author, creator, legitimate holder of the patrimonial/moral rights of the work or information, or are fully authorized by the rights holder to perform the registration;
- The document does not infringe third-party trademarks, patents, trade secrets, copyrights, or personality rights.
6.2. Absence of Prior Moderation or Attestation of Veracity:
Due to cryptography and local processing, Docmint has no knowledge, does not monitor, and does not evaluate the material content that gave rise to the hash.
The Platform solely attests to the existence and priority of the file at that exact moment in time. The registration of the hash on the blockchain does not transform an ideological falsehood into truth, nor does it validate illicit or plagiarized content created by the User.
If the User registers a third-party document without authorization, this registration will not grant the User real ownership of the right, prevailing the chronological order, the rules of the Copyright Law (Law No. 9.610/1998), and the investigation of fraud in the competent judicial sphere.
7. payments, prices, and refund policy
7.1. Credits and Payment Methods:
Docmint's services are prepaid through credit packages. Each recorded file consumes 1 (one) credit, including when recorded in a batch. Credits do not expire. Payment is made via PIX (processed by Mercado Pago) or international credit card (processed by Stripe), as available in the interface.
Courtesy credits (welcome or promotional bonuses) have no monetary value and are non-refundable.
7.2. Instant and Irrevocable Nature of the Blockchain:
When a record is confirmed, Docmint's automated system debits the corresponding credits, sends the transaction and pays the processing fees of the decentralized network (gas fees) for minting and anchoring the record.
The User expressly acknowledges that, due to the technical nature of blockchain technology, block-confirmed transactions are mathematically immutable and irreversible.
7.3. Right of Withdrawal (Consumer Defense Code):
Under art. 49 of the Consumer Defense Code (Federal Law No. 8.078/1990), the consumer has the right to withdraw from the contract within up to 7 (seven) calendar days.
However, in the case of a digital service of immediate execution and consumption, in which the service is fully completed and irreversibly recorded on the blockchain upon express request and payment by the User, with immediate consumption of network costs not refundable by external decentralized entities:
- If the blockchain transaction has already been processed and mined: The service is considered fully rendered and consummated, making it impossible to physically reverse or undo the recording on the blockchain, and no refund of the amount paid for the anchoring already performed is applicable.
- If a technical failure occurs in which credits are debited and the blockchain transaction is not completed, the credits are automatically returned to the User's balance.
- Purchased credits that have not been used may be refunded upon request through the contact channel within 7 (seven) calendar days of purchase.
8. legal validity and normative framework
The User and Docmint agree that the proofs generated on the Platform are based on the following Brazilian principles and legal diplomas:
- Code of Civil Procedure (Law No. 13.105/2015): Art. 369 (lawfulness of all moral and legitimate means of proof), Art. 411, item II (authenticity of digitally signed document without impugnation), and Art. 422 (electronic documents and data);
- Copyright Law (Law No. 9.610/1998): Art. 18 (copyright protection is independent of formal registration, with the timestamp serving as robust proof of creation priority);
- Provisional Measure No. 2.200-2/2001 (Art. 10, § 2): Recognition of the validity of electronic documents signed using methods not issued by ICP-Brasil, provided they are accepted by the parties as valid or admitted in court;
- Economic Freedom Law (Law No. 13.874/2019): Presumption of good faith and freedom in the development of innovative technological solutions and business models.
9. limitations of liability
Docmint shall under no circumstances be held liable for:
- Loss of the original file: Deletion, editing, improper saving, or corruption of the original file under the User's custody, preventing hash confirmation during verification;
- Registered content: False information, illegalities, or copyright violations perpetrated by Users who have generated records on the platform;
- Blockchain Network and Third-Party Protocols: Abnormal fluctuations in decentralized network fees, severe blockchain congestion, hard forks, 51% attacks on the consensus network, or structural instabilities in the public blockchain infrastructure used;
- User's Environment: Invasions, malware, adulterated browser extensions, or security vulnerabilities present on the User's computer or mobile phone;
- Interruptions in the PIX System: Temporary unavailabilities of the Instant Payment System (SPI/Central Bank of Brazil) or integrating financial institutions;
- Specific Judicial Decisions: Acceptance of the proof is subject to the prudent judgment of the magistrate conducting the judicial process, under the principle of motivated free conviction (art. 371 of the CPC), and Docmint cannot guarantee specific procedural outcomes.
Docmint's total financial and compensatory liability to the User, in case of proven failure of its own systems, will be strictly limited to the total amount effectively paid by the User to the Platform for the registration in question.
10. Docmint's intellectual property
10.1. Platform Assets:
The "Docmint" brand, logo, docmint.app domain name, visual layout, proprietary source code of the interface, visual marks, and Platform software are the exclusive property of Docmint or its licensors, being protected by Federal Laws No. 9.609/1998 (Software) and No. 9.279/1996 (Industrial Property).
10.2. Your Rights Remain Yours:
Registering a hash through the Platform does not transfer or license to Docmint any copyrights or intellectual rights over the registered document, work, or content. You remain the sole and exclusive holder of your copyrights.
11. privacy and data protection (LGPD)
11.1. Minimal Processing:
In strict compliance with the General Data Protection Law (Federal Law No. 13.709/2018 - LGPD), Docmint collects only the data strictly necessary for contract execution and compliance with legal obligations:
- Billing and payment data: PIX key, bank transaction identifier, and minimal registration data required by the payment gateway for issuing receipts;
- Browsing data: Access logs (IP address, date, and time) in compliance with Article 15 of Law No. 12.965/2014 (Brazilian Civil Rights Framework for the Internet);
- Document Hash: Pseudo-anonymized cryptographic string that does not allow reverse identification of the owner or the document's internal content.
11.2. No Commercialization:
Docmint never sells, rents, or cedes personal data or metadata of its Users to advertising companies or data brokers.
12. changes to the terms of use
Docmint reserves the right to update and modify these Terms at any time to reflect technical improvements, legislative adaptations, or changes in operating models.
The current version will always be published at https://docmint.app/ with the date of its last update visible at the top of the document.
Continued use of the Platform after the publication of modifications to the Terms will imply tacit and full acceptance of the new conditions.
13. general provisions
Autonomy of Clauses: If any clause or provision of these Terms is deemed invalid or unenforceable by a competent judicial authority, the remaining provisions will remain valid and in full force.
Tolerance: Any tolerance by either party regarding the breach of duties of these Terms will not constitute a waiver of rights, novation, or invokable precedent.
Communications: Doubts, legal communications, or support requests must be forwarded exclusively through the official channels made available on the Platform (docmint.app).
14. applicable law and forum selection
These Terms are governed, interpreted, and executed according to the laws of the Federative Republic of Brazil.
The Forum of the District of the User's domicile (in the case of an individual consumer in national territory) or, subsidiarily, the Forum of the District of the headquarters of the company operating Docmint is elected to resolve any controversies arising from these Terms, with the parties waiving any other, however privileged it may be.
